Inheritance, Purchase, and Sale of a Mooring in Spain

Owning a boat on the Spanish coast is usually linked to the ownership or right of use of a mooring. Moorings along the Spanish coast are managed by yacht clubs (Club Náuticos). Therefore, both the acquisition through purchase or inheritance and the sale are subject to certain legal particularities that must be taken into account:
Regulation of moorings: The use of moorings is subject to state regulations that govern their management through Club Náuticos.
Right of use instead of ownership: Moorings are part of the Spanish coastal area and therefore belong to the state. In general, private individuals can only acquire and transfer a right of use.
Prior approval from the Club Náutico: Since moorings are managed by Club Náuticos, both the purchase and sale require prior approval from the respective club. This process requires prior notification with the exact terms of the transaction.
Taxes: The transfer of mooring usage rights is considered an economic transaction and is therefore subject to taxation. The seller must pay taxes on the price received.
