In the case of an inheritance with assets in different countries, it is always necessary to prove your right of inheritance in order to be able to dispose of the inheritance by means of the so-called “proof of inheritance”.


The best known and most common proof of inheritance is a will. However, if there is a will, it is often necessary to prove the right of inheritance in another way.


In the case of intestate succession, if there is no will, the law must be applied to determine the heirs. In this case, other titles are required.


In Spain, the title of succession in the case of intestate succession is the “Declaración de Herederos Abintestato” (declaration of inheritance), which must be applied for before a notary.


In Germany, the inheritance courts determine the heirs through a so-called "Erbschein" (inheritance´s certificate). After the application has been submitted and the corresponding examination, the certificate of inheritance is issued.
